‘Top Secret’ emails found as Clinton probe expands to key aides

McClatchy Washington Bureau

WASHINGTON[ D.C.] — As pressure builds on Hillary Clinton to explain her official use of personal email while serving as secretary of state, she faced new complications Tuesday. It was disclosed her top aides are being drawn into a burgeoning federal inquiry and that two emails on her private account have been classified as “Top Secret.”

The inspector general for the Intelligence Community notified senior members of Congress that two of four classified emails discovered on the server Clinton maintained at her New York home contained material deemed to be in one of the highest security classifications – more sensitive than previously known.

The notice came as the State Department inspector general’s office acknowledged that it is reviewing the use of “personal communications hardware and software” by Clinton’s former top aides after requests from Congress.

Most seriously, the Inspector General assessed that Clinton’s emails included information that was highly classified—yet mislabeled as unclassified. Worse, the information in question should have been classified up to the level of “TOP SECRET//SI//TK//NOFORN,” according to the Inspector General’s report.

Now even worse.

This has progressed beyond the outrageous to the intolerable.

Enforce the Law.

  • Commander_Chico

Her candidacy should end if she left information which could “cause exceptionally grave damage to national security” on an unsecure system, but can she be prosecuted for a retroactive classification when she had declassification authority herself?

This may be Game of Thrones with Obama , Biden, Jarrett and Lynch sinking her.

    • jim_m

By your rationale, nothing on her server was classified because she had the authority to determine what was classified in the first place, so her declaration that the emails were not classified makes it so.

Under that definition nothing any high ranking public official does could ever be prosecuted because they determine the legality of their own actions.

The standard is whether or not that information would have been classified if it originated or existed on someone else’s computer.

The Inspector general has already stated that the documents were classified when they were originated.

      • Commander_Chico

If she transferred emails or documents which were originally classified and transmitted them on an unsecure system, she should be prosecuted.

It takes intent to do that – the classified and unclassified systems are separate and there is no way of inadvertently forwarding a classified email into an unclassified system.

She would have to download from the classified system onto a USB drive and upload it onto the unclassified system.

        • jim_m

Are you really that much of a dumbass. SHe was operating an unclassified email server out of her fucking basement. She has previously stated that NO classified information was EVER communicated over that server. It has already been demonstrated that this is a lie. It is almost a certainty that the Chinese read every single one of those emails.

She has also demonstrated that like most breathing people, she is capable of using a thumb drive.

          • Commander_Chico

What is wrong with you? I was agreeing with you, amplifying the facts, and you start foaming at the mouth because you haven’t got your rage quota for the day.

          • Oh, holy hell. “Wait, I didn’t think it was classified when I got it!” isn’t any sort of excuse at all.

And with the fight that’s been going on about her NOT letting her ‘yoga schedules and Chelsea Wedding’ emails be checked – I wouldn’t be at all surprised to find out she was forwarding classified info all over the place.

“Hey, Vlad – just FYI, this stuff on the Ukraine might be useful. Don’t forget the donations – keep ’em coming! Love, Hil.”

          • Commander_Chico

The NSA would know – all of our emails are on their server.

          • Lol. You’re probably right.

Then there’s this – I know it’s from Fox, but apparently now the theory is that people were stripping classification markers off documents, which is in itself a felony offense. Frankly, it’s looking worse and worse.

            (Caution: Autoplay video on it.)

“But a State Department official told Fox News that the intelligence community inspector general, who raised the most recent concerns about Clinton’s emails, made clear that at least one of those messages contained information that only could have come from the intelligence community.

“If so, they would have had to come in with all the appropriate classification markings,” the official said.

“The official questioned whether someone, then, tampered with that message. “[S]omewhere between the point they came into the building and the time they reached HRC’s server, someone would have had to strip the classification markings from that information before it was transmitted to HRC’s personal email.”

“The official said doing so would “constitute a felony, in and of itself. I can’t imagine that a rank-and-file career DOS employee would have done this, so it was most likely done by someone in her inner circle.”

“The messages apparently contained satellite imagery and signals intelligence, information that diplomats cannot unilaterally obtain.”

The thing I’m wondering about is how loyal her minions are going to be when faced with felony time in Leavenworth.

          • Commander_Chico

Yikes! Someone will take the fall.

          • Looks like they may be positioning Huma for it.

The bus runs over everyone, eventually…

        • Which makes me think that there’s some lowly intern somewhere who was busy with a thumb drive and a classified system that had its USB ports enabled – all to make sure the Queen had her emails.

That poor chump’s probably going to be taking the fall, and Hillary will just be going “Oh, I didn’t know that the material was classified! LOL.”

          • Commander_Chico

There’s a story I read about the guy who ran her email server – he was a campaign staffer who was brought into DOS as an IT staffer.

So she had a government employee doing it.

            I think she’s done.

          • I hope she’s done. But I think they’ll have to cut her figurative head off, fill her mouth with garlic and sew it shut, then bury her at a crossroads with a stake through her heart before she’s ‘done’ politically. And even then there would would some who’d worship her political corpse, and sacrifice anything necessary to ‘revive’ her.

(Wait, was I comparing her to a bloodsucking vampire? Why, yes… yes, I was.)

          • Commander_Chico

I just saw CNN putting her still ahead of Bernie at 17% Biden at 12% and Webb and O’Malley -at 1%!

Republican process is a hell of a lot more open for sure, however much it is manipulated.

          • Okay… garlic, beheading, stake, and then burial in a drum of holy water?

    • Darin Smith

She can only declassify information which she or her predecessor originally classified. If another original classification authority classified the information at the time of origination it is classified, whether properly marked or not.

      • Commander_Chico

You are correct. I was referring to information which should have been classifed, but was not and was transmitted on an unsecure system.

An example of that is the mobile phone call between Asst. SecState Victoria Nuland and Ambassador Pyatt in the Ukraine – “Fuck the EU!” – picked up by the Russians.

        • Well, I hate to say it (… no, not really) but she’s totally screwed the pooch regarding any sort of Comsec or Opsec. That alone should have the DNC dropping her as a candidate.

And yet, the idea that she should be given the keys to the Oval Office persists.

What IS there about the Clintons that seem to inspire some folks to want them as an ersatz Royal Family, with Chelsea as Heir Apparent? I don’t see it – I really don’t. Only one of the three with any charisma was Bill – and he’s only remembered as a success because of the Tech Bubble of the ’90s… which was popping as his second term expired.

          • Commander_Chico

Well, I think Bill was better than you say, but she’s shown a Nixonian paranoia and attempts to flout the law. And not too smart, either. She could have used her [email protected] occasionally and had the other account for her cronies like Huma and Sidney.

          • Bill knew to keep his fingers out of stuff he didn’t have any knowledge of, and listen to advisers who knew their field.

Hil? Not so much, I think.

          • Commander_Chico

She gets a charge out of being cute. I don’t mean physically cute.

          • Retired military

            But you were thinking it

        • Darin Smith

True. The executive order that allows for classification prohibits classifying info to prevent embarrassment. But using that filter nothing about her tenure at State could be classified since it is all embarrassing. Agree with your later comment. She’s done. The undercarriage of the bus will be quite crowded but this isn’t the blue dress lunacy of the Gingrich era. It’s real.

    • Retired military

But if she is the dem nominee you will vote for her anyway.

    • WTF?

I’m reminded of that Facebook commercial with the old lady stapling pictures to her wall, and her friend going “That’s not how that works. That’s not how ANY of this works.”

  • Oh no, political limbo won’t due.

    • Will Icare

and I’m never going back to that old fool…

      • jim_m

        “Old fool”

Not exactly a differentiating statement when talking about dem front runners.

  • Hank_M

This doesn’t happen without the Obama admin, specifically Jarrett, allowing it.
Also seems like an awful lot of people who donated to the Clinton Foundation are not going to get their money’s worth.

Still, bottom line, couldn’t happen to a more deserving crook.

  • Retired military

    a. I simply having trouble believing that the hard drive they got was the original server hard drive. My guess is the original hard drive is at the bottom of the Marinas Trench in about a million pieces.
    b. I believe this is some proof that Obama is working against Hillary.
    c. Where are the calls from the dems to frog march someone off to jail as they did when they thought Cheney had outed a CIA agent (but it turned out to be someone who was against the war and they quickly shut up that talk).
    d. Isnt Manning in jail for something similar?

    • Sky__Captain

      a. Agreed. But now we are talking obstruction of justice, and the Hildabeast still gets Comrade Chico’s vote.
      b. Yes, just so Joe “The Plagarist” Biden can run. And get Comrade Chico’s vote.
      c. You see, this time it’s the Dems’ gal who needs to go to jail thus the silence.
      d. IIRC, David Petraus got in trouble for classified info in a desk drawer.

      • Retired military

        A. Obstruction of Justice – prove it. Cheeko’s vote – Naturally
        b. If I was the republican nominee against Clinton my campaign slogan would be “You have see what the past 18 months has been like. Do you really want to see this for the next 4 years?” Cheeko’s vote – naturally.
        c. Exactly
        d. Yep but Petraus isnt the Hildabeast and Obama wanted to get Petraus.

  • Vagabond661

This is much more serious than a dog on the roof or a mistress. I expect wall to wall coverage by all of the media.

Oh wait…she’s a Democrat so just Fox and Breitbart.

  • LiberalNightmare

Hmmm, If Hillary was using a private email server while she served as secretary of state, I wonder what happened to the emails from her time as a senator?

    • Commander_Chico

Congress is not subject to the Freedom of Information Act – only the executive branch.

      • jim_m

Its the federal records act that is the relevant law here.

    • Retired military

They are at the bottom of the Marianas trench as well.

  • Jeffrey Ostermiller

Hillary just might have to learn to live in very closely guarded accomodations, appropriately decorated by the previous occupant Martha Stewart. Such pleasant thoughts that.

  • Hank_M

Another blogger, the Da Tech guy has an interesting point on all of this…

“Even though the Email scandal has and continues to have a devastating effect on Hillary’s numbers and her presidential campaign, to the Clinton team all this damage is preferable to having the emails from that server publicly released. Think long and hard about that.”

  • Retired military

    My predictions
    1. HIllary wont be charged with anything
    2. One of Hillary’s aides will take the fall (and get pardoned by either Obama or whoever the next dem president is),
    3. (I have no way to prove this) the person in number 2 will be given a handsome sum for their taking the fall in the 7 figures (even though Hillary and Bill are dead broke and have to worry about mortgages and stuff).
    4. Hillary will be the dem nominee.
    5. Charges of sexism (via the MSM and dem operatives (but then I repeat myself)) will be made against anyone who even dares bring this up.
    6. Cheeko will still vote for her and if elected will defend her for the next 4+ years and if not elected will say Option H Well xxxx is terrible and Hillary would have done a better job.
