A couple of reminders. There is no element of intent when it comes to failure to safeguard classified information. Cleared individuals have a legal duty to protect classified information. If classified information entrusted to a cleared person escapes their control, they are liable under the law. A person who is not cleared for information who is found in possession of it cannot be prosecuted for failure to safeguard it as they are not legally bound to. Further dissemination of information which is classified by a person or persons who do not carry security clearances can only be charged as Espionage.

She also claimed to have lost most of them as a result of the transition from the State Department – which she left on January 20, 2013
