    The DoJ needs to be cleaned out: “Judge Dismisses Bundy Case With Prejudice After Finding of Extensive Unethical Conduct By Federal Prosecutors”

    U.S. District Court Judge Gloria Navarro has issued a dismissal with prejudice against the Justice Department in the case against Cliven Bundy and his sons due to what Navarro describes as flagrant and knowing violations of professional ethics and federal law by the Justice Department. In past cases, the Justice Department has shown little commitment to discipline, let alone terminate, anyone for the violations (or the waste of millions of dollars)

    On the open-threadiness, a federal court has rejected the North Carolina legislative map for partisan gerrymandering.

    This is one of those cases where I like the outcome (invalidating a gerrymandered district map), but I’m not happy with how we get there. The Constitution is completely silent on using political criteria to draw congressional districts. You can probably make the case the Congress has the authority to restrict or halt the practice, but Congress has not done so.

    • If the Law is silent on the issue, then this is legislation from the bench.

    Scalia, if you’re reading, I wouldn’t mind seeing your opinion on this. Less about the incident, and more about the “forgiveness culture” that the author cites. To me, it seems to fly in the face of justice.
