Breaking: Rush Limbaugh Arrested

Updated

Rush Limbaugh was arrested today and charged with one count of prescription fraud (correction: Rush will not be charged if he meets requirements listed in press release below):

WEST PALM BEACH, Fla. -- Rush Limbaugh was arrested Friday on prescription drug charges, law enforcement officials said.

Limbaugh turned himself in to authorities on a warrant issued by the State Attorney's Office, said Teri Barbera, a spokeswoman for the State Attorney's Office.

The conservative radio commentator came into the jail at about 4 p.m. with his attorney Roy Black and bonded out an hour later on a $3,000 bail, Barbera said.

The warrant was for fraud to conceal information to obtain prescription, Barbera said.

Black said his client and authorities reached a settlement on a single count charge of doctor shopping filed Friday by the State Attorney will be dismissed in 18 months.

Prosecutors seized Limbaugh's records after learning that he received about 2,000 painkillers, prescribed by four doctors in six months, at a pharmacy near his Palm Beach mansion. They contend that Limbaugh engaged in "doctor shopping," or illegally deceived multiple doctors to receive overlapping prescriptions.

Limbaugh has not been charged and maintains he's innocent. He has acknowledged he became addicted to pain medication, blaming it on severe back pain, and took a five-week leave from his radio show to enter a rehabilitation program in 2003.

I'll post more information as I get it.

Update:

rl.jpg

Drudge has the above picture on his site which may be Rush's mug shot. If so, then he took a page from the Tom DeLay playbook and smiled so as to keep the liberals from gleefully plastering it all over their websites, t-shirts, coffee mugs etc. Drudge has Attorney Black's statement:

"I am pleased to announce that the State Attorney's Office and Mr. Limbaugh have reached an agreement whereby a single count charge of doctor shopping filed today by the State Attorney will be dismissed in 18 months. As a primary condition of the dismissal, Mr. Limbaugh must continue to seek treatment from the doctor he has seen for the past two and one half years. This is the same doctor under whose care Mr. Limbaugh has remained free of his addiction without relapse.

"Mr. Limbaugh and I have maintained from the start that there was no doctor shopping, and we continue to hold this position. Accordingly, we filed today with the Court a plea of 'Not Guilty' to the charge filed by the State.

"As part of this agreement, Mr. Limbaugh also has agreed to make a $30,000 payment to the State of Florida to defray the public cost of the investigation. The agreement also provides that he must refrain from violating the law during this 18 months, must pay $30 per month for the cost of "supervision" and comply with other similar provisions of the agreement.

"Mr. Limbaugh had intended to remain in treatment. Thus, we believe the outcome for him personally will be much as if he had fought the charge and won."

The actions taken today are as follows:

The State Attorney has filed a single charge of doctor shopping with the Court. The charge is being held in abeyance under the terms of an agreement between the State and Mr. Limbaugh.

Mr. Limbaugh has filed a plea of "Not Guilty" with the Court.

The formal agreement between Mr. Limbaugh and the State Attorney will be filed with the Court on Monday. The terms of the agreement are substantively as follows:

Ø Mr. Limbaugh will continue in treatment with the doctor he has seen for the past two and one half years.

Ø After Mr. Limbaugh completes an additional 18 months of treatment, the State Attorney has agreed to drop the charge.

Ø Mr. Limbaugh has agreed to make a $30,000 payment to the State of Florida to defray the public cost of the investigation.

The prosecutor should pay the $30,000 fine since he's the one who initiated this witch hunt.

Rush addressed the settlement on his website; however, there isn't a link attached to it right now.

Update II: Rush's link is now live.

Update III: About Rush's arrest (it technically wasn't an arrest since Rush turned himself in), Lucianne says "He'll be fine. It sounds worse than it is."

In the most basic sense of the word (do as I say not as I do), then Rush is a hypocrite.

Does anyone here really think that recreational drug use and prescription pain reliever addiction is comparable at any level except the most rudimentary "they took drugs illegally" argument?

If so, then you truly exhibit how out of touch you are with the real facts here.

Did Rush do something illegal. Yup. Was there any need to expend $30K of taxpayers' money to pursue records that prove what he admitted to doing? Uh, no.

And there's your answer to the "witch hunt" question, Lee. Why go to so much expense to prove that Rush did exactly what he admitted to, unless the prosecutor was trying like crazy to find something else--that ultimately didn't exist. This obsession with finding illegal activity or embarassing facts that could damage Rush's reputation further, and ultimately (and for the prosecutor "hopefully") destroy his career.

(for further explanation, please review the Salem Witch Trials before you repost the same stupid question...perhaps if you understood what a "witch hunt" was, you'd be able to see why this is rightly classified as such)

Hey squoozy or whatever

I used Goebbles as an example of a propaganda meister who twisted lies into truth. Coincidentally, Dr. Goebbles ( he was a doc of something or other) happened to work for the previous Fuehrer.

I never meant to suggest that our dear LimBARF, who also, coincedentally, fancies himself as a doctor ((quack) of sorts, was a Nazi, as I have never heard him express any empathy for the 1st Fuehrer.

My point was simply to suggest that Goebbles & LimBARF share a common trade; namely Propagandist.

Had LimBARF been available for recruitment in the 30's & 40's, his talents could have assured a German victory in WWII. Hell, FDR likely would have fallen to the LimBARFian Sirens' sway.

TO frankfucszeroiq, or is it frankallfucszindahead

The LimBARF med record search was ultimately sustained in court, so you don't know what the hell you're babbling about.

Besides, in these days of an unfettered NSA for security at any costs, it is simply fitting, just fitting that a tink of leeway be taken w/ LimBARF's med records to help prevent this nation from becoming overrun with opiated drug addicts bloviating their bilge & bile on broadcast networks where they might have a harmful & deleterious effect on impressionable youth & on an allegedly adult audience of impressionable sheeple aka Pavlovian Puppies.

This nation faced an utterly severe, clear & present danger: that w/ the simple ring of the Doctor's bell, a rattle of a sheaf of papers or an upraised formerly-opiate-stained finger, millions of sycophants could have been sent panting for Oxycontin scripts, or opium hookahs at least as would be the case w/ thelower-income sycophants (read that: human debris).

I hope you never get serious back or other problems. I have a friend that sat around in a drug induced stupor from these legal prescriptions for a year before having a knee replacement. He could take 3-4 times the dosage that he had for Vicodin, etc. and still not have relief.

I've heard all kind of screaming about Bush violating 'privacy rights' while trying to find terrorists by not getting warrants from FISA courts, yet a fishing expedition into medical records, which is never supposed to happen, by a political prosecutor, is OK just because it was LimBARF.

he LimBARF med record search was ultimately sustained in court, so you don't know what the hell you're babbling about.

How many times have political appointed courts been overturned? Contrary to the spin that you try to put on it, this is over. He plead 'not guilty'. Keep his nose clean, and the prosecutor will drop the charges in 18 months. Without the trial that you so desperately want. End of story.

Keep babling. You amuse me. Just take a deep breath every once in a while or you will stroke out.

Does anyone here really think that recreational drug use and prescription pain reliever addiction is comparable at any level except the most rudimentary "they took drugs illegally" argument?

Is there another argument? Does there need to be?

I believe the basic argument against illegal aliens -- however much they may contribute to our way of life -- is that they are here illegally: they have broken the law. Or do you not find illegality a persuasive legal argument?

Did Rush do something illegal. Yup. Was there any need to expend $30K of taxpayers' money to pursue records that prove what he admitted to doing? Uh, no.

I haven't heard Rush bleating about being forced to shell this $30k out. Just who are you taking issue with, Rush or the law enforcement establishment?

Hey Jamie

You are the perfect example of the LimBARFian method of standing Reason on its head.

Following your LimBARFian logic, one could easily say that, if all that you propound were valid, then the grossest example of a Salem Witch Hunt was the Right-wingnut extremest incessant hunt of the Clintons for 8 years, ultimately resulting in entrapment in a lie that would never had been uttered but for the relentless witch hunt.

All this, not at a cost of 30K, but rather 10's of millions of taxpayers' dollars & at the cost of an Administration's inability to devote full attention to its elected charge of duty. This was foisted on Our Nation by hordes hating fanatics, petty and hateful GOP pols and a self-serving Special Prosecutor who usurped his initial charge in order to pursue the Clintons in an infitnitely more vicious mode than the wickedly fanatic Javert.

And now that modern day Javert, for his reward, sits as the Dean of the Pepperdine Law School, no doubt in the furtherance of his perversion of the concept of Law.

Subsequently, the Javert persecution was followed by a Republican Witch-dunking impeachment, led by none other than the GOP's very own congressional Javert, their most brilliant beacon of Propriety & Moral Behavior , Tom DeLay, at a great National trauma & National cost for a single charge of perjury resulting from an all-too human trait that most any person would have succumbed to to protect themselves and/or their family from opprobrium.

If your lame and deceitful refutation above isn't THE CLASSIC EXAMPLE OF LIMBARFIAN HYPOCRISY & LIMBARFIAN ILL-LOGIC , then "hypocrisy" is a non-existent behavior.

You LimBARFian salivating puppies are beyond rational and intellectual redemption.

"Why go to so much expense to prove that Rush did exactly what he admitted to, unless the prosecutor was trying like crazy to find something else--that ultimately didn't exist."

1) Fat boy plead not guilty. The fight was on at that point.

2) Once it (the details of rush's drig abuse) was out in open the DA couldn't ignore it, no could he/she? They had to pursue the matter.

3) I suspect it was so expensive to investigate because fat boy kept lying and putting up road blocks. That's why it was required that he pay $30,000 in investigation costs.

4. Fat boy is GUILTY, and that's why he paid the $30,000 and agreed to stay in rehab, rather than fight the charges. Rush has the money to fight the charges, and could have raised millions from his worshipers to fight any false charges.

btw - rehab isn't necessary unless you have a drug problem. The hypocrisy of the guru of gluttony is yet another shining example of the moral low road taken by this clown. If he had plead guilty I might have a half-ounce of respect for this clown -- but for him to maintain his innocence makes the entire right-wing moral-majority leadership the laughing stock of the world.

What you have not quite grasped from your MahaRushee is simply that the MahaRushee alone is the Meister of fabricating out of whole clothe ( and he does that quite well) and you minions are simply meant to do your duty and swallow the Meister's regurgitated chyme.

No, what you have not grasped is that what Limbaugh does is express his opinion, which he does well. He gets under your skin, doesn't he? I am free to listen, agree when I do, and disagree when I don't. Plus, I have an "off" switch on my radio that I use when I get tired of something that he or any other pontificator says. Apparently other folks didn't by radios with that switch, or failed to read the instructions on theirs. As to the statement that he fabricates, I assume you are saying, everything out of whole cloth, yes there are some things that he fabricates. Intentionally to get a rise out of the likes of you. It takes a keen mind to see through the satire.

Minions w/ minimal neurons should leave the propaganda fabrication to the expert. You were intended to listen & swallow.

No, myrmidons like you were intended to spout the BS that you continually spew. The rest of us are free to think, accept what we see as reasonable, and reject the rest. It's a beautiful thing.

No. I intended to say 'your'. Some other folks might say "yurin" "hisin" "herin" "theirin", but I don't. I haven't run in to too many people around here that talk like that. Maybe 30 years ago, but not now.

I suppose you are from an area where everyone is morally superior in intelect and thought. At least that's what you think. Your posts indicate that. I'm proud to be from where I am. I was born and grew up in a suburb of Greenville, South Carolina. Spent time in Columbia, South Carolina and Augusta, Georgia. I now live in an Atlanta suburb, northwest of the city. My job takes me to different places around the world, I spent a couple of months in El Salvador in 2004. Spent almost 2 months in Mexico last year. This year, I've only spent a couple of days in Mexico. Looks like this year will be mostly the US and Canada. Everywhere I've been, they have asked me where I grew up. I'm proud to tell them.

These are excerpts from a summary of the Health Insurance Portability and Accountability Act of
1996 (HIPAA) [the law that currently covers medical privacy]:

Disclosures to law enforcement officials

The Privacy Rule includes a standard for disclosures to law enforcement officials. The standard permits the following types of disclosures:

* Pursuant to a legal process or otherwise required by law, including disclosures of certain types of wounds, and disclosures in response to court orders, subpoenas, and administrative requests. Administrative requests must be specific and limited, relevant to a legitimate ongoing investigation, and must demonstrate that de-identified information (that is, information without individual identifiers) cannot be used.
* Limited information disclosures for the location of a fugitive, suspect, material witness or missing person.
* Information about an individual who is or is believed to be a victim of crime if the individual agrees to the disclosure or, under specific rules, if the individual is unable to agree or object.
* Information about decedents.
* Information about crime on the premises of the covered entity if there is a good faith belief that the disclosed PHI is evidence of a crime.
* Limited disclosure in emergencies in order to alert law enforcement about the commission of a crime.

Additional disclosures to law enforcement officials are permitted under other parts of the Privacy Rule. For example, disclosure is permitted if a covered entity believes that an individual may pose serious threat to health and safety and the disclosure may help law enforcement authorities reduce the harm or apprehend the individual.

Although disclosures to law enforcement authorities may be made without individual authorization and, in some cases, without giving the individual an opportunity to agree or object, such disclosures generally become part of Accounting for Disclosures that an individual can request from a covered entity. If a law enforcement official requests that law enforcement-related disclosures not be listed in the Accounting for a specified period of time, the entity providing the Accounting must suspend the individual's right to see a listing of such disclosures.

[snip]

Regulations dealing with substance abuse are more stringent then the Privacy Rule when it comes to disclosures related to law enforcement. Information related to substance abuse may not be disclosed to law enforcement officials without individual authorization. [empahsis added}

Note the last sentence. I'm no authority on HIPPA, but I saw how protective the medical records department of a hospital that I did a few weeks IT work for under contract [I'm not a doctor but I play one on TV ;-}]. If I understand the last paragraph correctly, No DA or court has the authority to dig through your or anyone else's records without the authorization of the individual being investigated. That's where I conclude that it was a 'witch hunt' with an open ended warrant. It was a violation of Federal Law.

Perhaps there is someone more versed on HIPPA than you and I that can shed some light on this.

My Dad used to ride me about my political bent- he was a southern Democrat- but he told me about 15 years ago that I had been right all along. He's more conservative than I am, I lean libertarian, but I disagree with the direction of the Libertarian party, so I work in a different direction.

Doesn't surprise me at all. Major corporations settle lawsuits all the time without admitting guilt, and many times they are not. It's cheaper and better publicity to just settle. And Limbaugh is a major corporation, in essence.

Think about it, the blogsphere and the antique media will be abuzz with this for this weekend, and the news shows tomorrow will address the issue. Just look at the attention that this thread has on just this blog. But in a few days, the media and the politicos will move on to the next big thing. Besides, gas prices are going to steal the spotlight again sooner rather than later. A trial drags on for months, even years. In 18 months, baring further developments or a violation of the agreement, it will all be over, with the county pocketing $30g and Limbaugh with a dismissed case and a 'Not Guilty' plea. Using the same reasoning that you used, if the DA did violate the HIPPA regs, he's more than happy to agree to this settlement. $30g is a pittance for Limbaugh, cheaper than legal fees for a trial.

Joel-- in some ways I am like you, but in reverse. I grew up as a would-be John Bircher in a family, where the careless mention of FDR by name would bring an onset of ranting by my father for the better part of an everning. I was indoctrinated until I encountered a history prof who forced me to think and a left-leaning landlady/university professor in her 60's & in the forefront of campus politics.

She said one night as we argued endlessly, "If you're so damned conservative now at your age, what the hell are you going to be like when you reach my age?"

There wasn't much room left to move except fascism, given the state of my political philosophy at that time.

I have a pretty good idea of how the thinking goes on both sides because I started out about as far right as one can be w/o brandishing a swastika or wearing an Iron Cross and I am ashamed to admit that, at the time of Kennedy's assassination, I thought the country was better off for having been saved from Communism. It's hard to start out much lower than that. It's been a long way outta a hole like that but I made it years ago.

'68 was my 1st election & I was so pissed about Viet Nam by then that I was going to vote for Nixon out of protest... that is, until I thought about the Supreme Court implications of that kind of foolishness and I changed my mind. The Court has been on a slow descent ever since Nixon's appointments until it is now nothing but a reflection of the darker side of humanity, for the most part.

BTW The history of the Supreme Court reflects, that over time & as small-mindedness & the iron death grip of conservatism has been breached, it has been a powerful force for change when no other part of our government would move, Unfortunately the times in between those flashes of brilliance have too often lasted longer than a lifetime and many of our forebears have suffered greviously for the glacial pace. This present court is a glacier across the path of human advancement for the next 30-40 years & this nation and this world cannot sit by & twiddle their thumbs til a mid-century wakeup call at last occurs. By then it will be too late.

Apologies to others for the diversion.

There is a big difference between feeding an addiction to pain medication that was created after serious surgery, and giving the ol' wink-and-nod to recreational drug use, even just by commenting on "inhalation".

And, as for medical marajuana ... prove that it is safe and effective to the FDA, just like any other drug ... and you can also denounce the abuse of that "medicine" for recreational purposes, while you're at it -- for if more people agree with you, it may make it easier to get the research done to prove (or disprove) the usefulness of medical marajuana.

astigfa,
I just said that he had not commented since '95. I guess I should have prefaced that with before his addiction came up. No, I didn't hear his comment on the FDA story. I don't listen all the time. But it is a comment on the FDA announcement, and on an illegal substance, not on abuse and addiction, caused by a medical problem, to a highly addictive legal substance. I guess he has no right to say anything, on any subject, in your opinion.

Before you start accusing me of agreeing with the comment, I don't. I think the FDA is full of it on this subject. And no, I don't smoke it, even though I have glaucoma. Never had to dodge that I didn't inhale and I didn't enjoy it, because I have never tried it, even though I have friends that have, and use it now.

The war on drugs is big business. Monies could be better spent on treatment than enforcement and incarceration, IMHO. But there's a lot of difference between abuse of clearly illegal substances and becoming addicted to a substance legally prescribed in good faith.
