Rush Limbaugh was arrested today and charged with one count of prescription fraud (correction: Rush will not be charged if he meets requirements listed in press release below):
WEST PALM BEACH, Fla. -- Rush Limbaugh was arrested Friday on prescription drug charges, law enforcement officials said.
Limbaugh turned himself in to authorities on a warrant issued by the State Attorney's Office, said Teri Barbera, a spokeswoman for the State Attorney's Office.The conservative radio commentator came into the jail at about 4 p.m. with his attorney Roy Black and bonded out an hour later on a $3,000 bail, Barbera said.
The warrant was for fraud to conceal information to obtain prescription, Barbera said.
Black said his client and authorities reached a settlement on a single count charge of doctor shopping filed Friday by the State Attorney will be dismissed in 18 months.
Prosecutors seized Limbaugh's records after learning that he received about 2,000 painkillers, prescribed by four doctors in six months, at a pharmacy near his Palm Beach mansion. They contend that Limbaugh engaged in "doctor shopping," or illegally deceived multiple doctors to receive overlapping prescriptions.
Limbaugh has not been charged and maintains he's innocent. He has acknowledged he became addicted to pain medication, blaming it on severe back pain, and took a five-week leave from his radio show to enter a rehabilitation program in 2003.

Drudge has the above picture on his site which may be Rush's mug shot. If so, then he took a page from the Tom DeLay playbook and smiled so as to keep the liberals from gleefully plastering it all over their websites, t-shirts, coffee mugs etc. Drudge has Attorney Black's statement:
"I am pleased to announce that the State Attorney's Office and Mr. Limbaugh have reached an agreement whereby a single count charge of doctor shopping filed today by the State Attorney will be dismissed in 18 months. As a primary condition of the dismissal, Mr. Limbaugh must continue to seek treatment from the doctor he has seen for the past two and one half years. This is the same doctor under whose care Mr. Limbaugh has remained free of his addiction without relapse.
"Mr. Limbaugh and I have maintained from the start that there was no doctor shopping, and we continue to hold this position. Accordingly, we filed today with the Court a plea of 'Not Guilty' to the charge filed by the State."As part of this agreement, Mr. Limbaugh also has agreed to make a $30,000 payment to the State of Florida to defray the public cost of the investigation. The agreement also provides that he must refrain from violating the law during this 18 months, must pay $30 per month for the cost of "supervision" and comply with other similar provisions of the agreement.
"Mr. Limbaugh had intended to remain in treatment. Thus, we believe the outcome for him personally will be much as if he had fought the charge and won."
The actions taken today are as follows:
The State Attorney has filed a single charge of doctor shopping with the Court. The charge is being held in abeyance under the terms of an agreement between the State and Mr. Limbaugh.
Mr. Limbaugh has filed a plea of "Not Guilty" with the Court.
The formal agreement between Mr. Limbaugh and the State Attorney will be filed with the Court on Monday. The terms of the agreement are substantively as follows:
Ø Mr. Limbaugh will continue in treatment with the doctor he has seen for the past two and one half years.
Ø After Mr. Limbaugh completes an additional 18 months of treatment, the State Attorney has agreed to drop the charge.
Ø Mr. Limbaugh has agreed to make a $30,000 payment to the State of Florida to defray the public cost of the investigation.
The prosecutor should pay the $30,000 fine since he's the one who initiated this witch hunt.
Rush addressed the settlement on his website; however, there isn't a link attached to it right now.

Update III: About Rush's arrest (it technically wasn't an arrest since Rush turned himself in), Lucianne says "He'll be fine. It sounds worse than it is."

Limbaugh was caught - the same Limbaugh who said:
"Drug use, some might say, is destroying this country. And we have laws against selling drugs, pushing drugs, using drugs, importing drugs. ... And so if people are violating the law by doing drugs, they ought to be accused and they ought to be convicted and they ought to be sent up."

And you will see posts and comments frequently on this site decrying drug use, or claiming someone has "inhaled" -- yet when the fat guru of gloat gets caught it's a witch hunt.
Why did he agree to pay the $30,000 in investigate costs if he's not guilty?
because he is guilty, a fact also demonstrated by Limbaugh's agreement to stay in treatment.

Does anyone here really think that recreational drug use and prescription pain reliever addiction is comparable at any level except the most rudimentary "they took drugs illegally" argument?
If so, then you truly exhibit how out of touch you are with the real facts here.
Did Rush do something illegal. Yup. Was there any need to expend $30K of taxpayers' money to pursue records that prove what he admitted to doing? Uh, no.
And there's your answer to the "witch hunt" question, Lee. Why go to so much expense to prove that Rush did exactly what he admitted to, unless the prosecutor was trying like crazy to find something else--that ultimately didn't exist. This obsession with finding illegal activity or embarassing facts that could damage Rush's reputation further, and ultimately (and for the prosecutor "hopefully") destroy his career.
(for further explanation, please review the Salem Witch Trials before you repost the same stupid question...perhaps if you understood what a "witch hunt" was, you'd be able to see why this is rightly classified as such)

I hope you never get serious back or other problems. I have a friend that sat around in a drug induced stupor from these legal prescriptions for a year before having a knee replacement. He could take 3-4 times the dosage that he had for Vicodin, etc. and still not have relief.
I've heard all kind of screaming about Bush violating 'privacy rights' while trying to find terrorists by not getting warrants from FISA courts, yet a fishing expedition into medical records, which is never supposed to happen, by a political prosecutor, is OK just because it was LimBARF.
How many times have political appointed courts been overturned? Contrary to the spin that you try to put on it, this is over. He plead 'not guilty'. Keep his nose clean, and the prosecutor will drop the charges in 18 months. Without the trial that you so desperately want. End of story.

I believe the basic argument against illegal aliens -- however much they may contribute to our way of life -- is that they are here illegally: they have broken the law. Or do you not find illegality a persuasive legal argument?

3) I suspect it was so expensive to investigate because fat boy kept lying and putting up road blocks. That's why it was required that he pay $30,000 in investigation costs.
4. Fat boy is GUILTY, and that's why he paid the $30,000 and agreed to stay in rehab, rather than fight the charges. Rush has the money to fight the charges, and could have raised millions from his worshipers to fight any false charges.
btw - rehab isn't necessary unless you have a drug problem. The hypocrisy of the guru of gluttony is yet another shining example of the moral low road taken by this clown. If he had plead guilty I might have a half-ounce of respect for this clown -- but for him to maintain his innocence makes the entire right-wing moral-majority leadership the laughing stock of the world.

If the prosecutor had anything of a case, anything at all, he'd have gone to trial. But without any evidence of a crime to pursue a case now he had to convince Limbaugh to an agreement that will at least allow the prosecutor to save face somewhat.
Anyone who thinks this is a loss for Rush is a fool as anyone who has had to deal with prosecutors knows who ultimately won in this deal.

Is it your contention that open-ended warrants are not issued routinely? Is it Rush's contention? Were that the case, wouldn't Rush be anxious to prove he was unfairly prosecuted? Wouldn't he be reluctant to pay $30,000 investigation costs? Wouldn't he want to prove his innocence?

I've tangled with many oxycodone freaks, and its a tough addiction to treat. Denial and subterfuge are common traits that are difficult to deal with. I am not against appropriate consequences for these devious actions.
Now whether that's the case here will be hard to tell = Rush could have as easily copped a plea and paid the 30k to avoid the nuisance of defending himself at trial as he could have agreed to an appropriate punishment. It doesn't matter to me. He's got the spotlight on him, is at least on the face of it committed to rehab and the whole world is watching. It is hoped the DA offers the same resources to thwart all the oxy addicts in his jurisdiction. I'm sure most doctors and pharmacists would be overjoyed.
All this vicious diatribe has nothing to do with RL but everything to do with adolescent hormone storm and immature baiting - blog space is cheap but its still a sad thing to waste.

Note the last sentence. I'm no authority on HIPPA, but I saw how protective the medical records department of a hospital that I did a few weeks IT work for under contract [I'm not a doctor but I play one on TV ;-}]. If I understand the last paragraph correctly, No DA or court has the authority to dig through your or anyone else's records without the authorization of the individual being investigated. That's where I conclude that it was a 'witch hunt' with an open ended warrant. It was a violation of Federal Law.
Perhaps there is someone more versed on HIPPA than you and I that can shed some light on this.

You've got it wrong, Limbaugh didn't make me this way. I was real interested in politics in elementary school starting in the 5th grade. Almost voted for Carter in '76 in my first election, got caught up in the smile [notice I said almost, saw the light about a week before the election]. My Dad used to ride me about my political bent- he was a southern Democrat- but he told me about 15 years ago that I had been right all along. He's more conservative than I am, I lean libertarian, but I disagree with the direction of the Libertarian party, so I work in a different direction.

Using the same reasoning that you used, if the DA did violate the HIPPA regs, he's more than happy to agree to this settlement. $30g is a pittance for Limbaugh, cheaper than legal fees for a trial.
RE: Atlas Shrugged, too late, I started last weekend and I'm on the next to last chapter. I'm amazed that I started to read it again as it came into the news about the movie rights being sold yesterday.

I grew up as a would-be John Bircher in a family, where the careless mention of FDR by name would bring an onset of ranting by my father for the better part of an everning. I was indoctrinated until I encountered a history prof who forced me to think and a left-leaning landlady/university professor in her 60's & in the forefront of campus politics.
She said one night as we argued endlessly, "If you're so damned conservative now at your age, what the hell are you going to be like when you reach my age?"
There wasn't much room left to move except fascism, given the state of my political philosophy at that time.
I have a pretty good idea of how the thinking goes on both sides because I started out about as far right as one can be w/o brandishing a swastika or wearing an Iron Cross and I am ashamed to admit that, at the time of Kennedy's assassination, I thought the country was better off for having been saved from Communism. It's hard to start out much lower than that. It's been a long way outta a hole like that but I made it years ago.
'68 was my 1st election & I was so pissed about Viet Nam by then that I was going to vote for Nixon out of protest... that is, until I thought about the Supreme Court implications of that kind of foolishness and I changed my mind. The Court has been on a slow descent ever since Nixon's appointments until it is now nothing but a reflection of the darker side of humanity, for the most part.
BTW The history of the Supreme Court reflects, that over time & as small-mindedness & the iron death grip of conservatism has been breached, it has been a powerful force for change when no other part of our government would move, Unfortunately the times in between those flashes of brilliance have too often lasted longer than a lifetime and many of our forebears have suffered greviously for the glacial pace. This present court is a glacier across the path of human advancement for the next 30-40 years & this nation and this world cannot sit by & twiddle their thumbs til a mid-century wakeup call at last occurs. By then it will be too late.

There is a big difference between feeding an addiction to pain medication that was created after serious surgery, and giving the ol' wink-and-nod to recreational drug use, even just by commenting on "inhalation".
And, as for medical marajuana ... prove that it is safe and effective to the FDA, just like any other drug ... and you can also denounce the abuse of that "medicine" for recreational purposes, while you're at it -- for if more people agree with you, it may make it easier to get the research done to prove (or disprove) the usefulness of medical marajuana.
BTW, all Rush did for me was to reinformce what I had already observed and discerned ... which was refreshing when you have been immersed in the MSM information sea, and selectively spoon-fed only those parts of the truth that line up with the Utopian/hedonistic worldview they consider "enlightened", but is instead lacking in even simple wisdom.
Professing to be wise, they proved to be fools -- and many still are. OTOH ...

I just said that he had not commented since '95. I guess I should have prefaced that with before his addiction came up. No, I didn't hear his comment on the FDA story. I don't listen all the time. But it is a comment on the FDA announcement, and on an illegal substance, not on abuse and addiction, caused by a medical problem, to a highly addictive legal substance. I guess he has no right to say anything, on any subject, in your opinion.
Before you start accusing me of agreeing with the comment, I don't. I think the FDA is full of it on this subject. And no, I don't smoke it, even though I have glaucoma. Never had to dodge that I didn't inhale and I didn't enjoy it, because I have never tried it, even though I have friends that have, and use it now.
The war on drugs is big business. Monies could be better spent on treatment than enforcement and incarceration, IMHO. But there's a lot of difference between abuse of clearly illegal substances and becoming addicted to a substance legally prescribed in good faith.
