CAMP PENDLETON, Calif. - Seven Marines and a Navy corpsman were charged Wednesday with premeditated murder in the shooting death of an Iraqi man and could face the death penalty if convicted.

All eight also were charged with kidnapping. Other charges include conspiracy, larceny and providing false official statements.

Col. Stewart Navarre, chief of staff for Marine Corps Installations West, announced the charges at Camp Pendleton Marine Corps base, where the eight are being held in individual cells for 23 hours each day. The troops are members of the Pendleton-based 3rd Battallion, 5th Marines Regiment.

So is this another case where there's is no comment because they investigation is still underway? CHARGES HAVE BEEN FILED.

But wait, there's a rumor of a scandal involving Kos, and once again Whizbang! is all over it. What about waiting until the investigation is over are all of the facts are known on this?

8 U.S. troops charged with murder

Charging document gives account

The Associated Press obtained a copy of the charging document, which gives the following account:

The troops were staking out an intersection looking for people placing explosives along the road. When no one came, Magincalda, Thomas, Pennington and Bacos stole a shovel and an AK-47 from a nearby home and went looking for an insurgent named Saleh Gowad.

They couldn't find Gowad, so they went into a house belonging to Awad and kidnapped him. Magincalda, Thomas, Pennington and Bacos forced Awad to the ground, tied his feet and took him to their hideout and placed him in a hole.

Hutchins, Thomas and Shumate fired M-16 rifles at Awad while Jackson and Jodka fired M-249 automatic weapons, killing him.

Bacos then fired the AK-47 into the air to expend some shell casings. Magincalda collected the casings and put them by the body, the document said. Pennington cleaned prints off the AK-47 and put it in Awad's hands.

Hutchins, the top-ranking Marine, told his men to make false statements and on April 28 submitted "a false written report regarding the factors and circumstances related to Awad's death," according to the document.

You know what, Lee? People get charged with murder right here in the good old USA every day. Sad but true. To expect we could have so many people over there for so long and expect that none of them would ever commit a crime is probably setting those expectations too high. Yes, sadly, people do things like that. Look at New Orleans last weekend. Look at Milwaukee on Memorial Day weekend (28 shootings).

Our military is only a reflection of the population it draws from but I will tell you what ... grab 300,000 people with an average age of 19 at random off our city streets and arm them with the firepower our soldiers have and you tell me who you would feel safer standing near.

Our troops are capable of committing a crime and if they have, then they should be given a trial and if found guilty should be punished. But your reaction itself goes to show that this kind of act is the exception rather than the norm. Part of the problem is that our mass media has been spring-loaded to yell loud whenever someone brings an accusation that it gives the false appearance that it is more common than it is.

The charges leveled are not related to Haditha, and thus were not discussed by Murtha, so Lee doesn't have a point. If anything, the charges prove the system works and disproves the liberal Murtha mantra that there are 'coverups'.
