Judge Dismisses Child Porn Charges Agains John Mark Karr

The investigators lost the evidence. Can you say total incompetence?

A judge dismissed child pornography charges Thursday against one-time JonBenet Ramsey slaying suspect John Mark Karr after Sonoma County prosecutors said they didn't have enough evidence to take the case to trial.

Judge Rene Chouteau ordered Karr released immediately, bringing an end to his two-month odyssey in the U.S. criminal justice system after he was extradited from Thailand on suspicion of killing JonBenet.

Karr, 41, returned to Sonoma last month to face the five-year-old case after DNA evidence cleared him of killing the child beauty queen in her Boulder, Colo., home in 1996.

The Sonoma misdemeanor case fell apart almost as quickly, as investigators admitted losing vital computer evidence seized from Karr in April 2001 when he was working as a substitute teacher in Sonoma and Napa counties.

Defense lawyers tried unsuccessfully to get the charges dismissed and were seeking to have evidence barred from trial when prosecutors gave up.

"The impression that we've had all along is that the prosecution had every intention of getting this case to trial, regardless of the evidence," said defense lawyer Robert Amparan. "I am pleasantly surprised by them having done the right thing."

Prosecutors acknowledged that if Karr were convicted he would not have served any additional time in jail because he spent several months behind bars awaiting trial in 2001. They said they were seeking to have him register as a sex offender.

This guy is a pedophelia time bomb waiting to explode and needs to be off the streets, but once again he walks free. Unbelievable.

Hat tip: Stop the ACLU

He got a free ride home from Thailand before he could be charged with anything there. Probably copped to JonBenet just to do so...

If Karr was being held in Thailand on child sex charges, and then was extradited here, what is to keep us from remanding him back to Thailand to face the original charges that they picked him up on?

Of course, if the Thais don't have charges on him, that's a different story, but I thought they did??

Yes, they may not be able to arrest him now, but I sure hope that he is put under permanent surveilance in the future. Hate to see him get off the hook here, but the law does not provide for jailing future law-breakers (unfortunately)...

No, I can't. Mistakes happen. There's nothing to indicate in the information you've provided that there is a pattern of incompetence here.

The vast majority of work performed by law enforcement personnel is first rate. I do wish the Republicans would support law enforcement, instead of belittling them.

New flash, people - this is not a Republican vs. Democrat issue. There are actually a few news stories that are not connected to a political agenda.

Today a demented pedophile is walking the streets freely, looking for his next young victim, because someone in law enforcement didn't do their job properly. That's the bottom line. I know most cops and investigators do a good job (my brother is one), but this time someone messed up and it may have deadly consequences. There's nothing political about that.

Actually that was my point. Perhaps it should have been made in a Foley thread, but this is people's response to pedophilia sans politics. We get "Mistakes happen" from one of the resident lefties. I wonder if he has the same opinion of Hastert & co.

But yeah, it was probably a mistake to mention it here and should have linked to this from a Foley thread.

It's an odd shift we've seen recently, with Republicans no longer supporting their local law enforcement to the extent they used to, and more police and fire endorsements of Democratic candidates. I guess this comment threads illustrates why.

Mark:

I think this guy needs help, but I wouldn't have wanted my tax dollars to pay for that or jail. In a way, I was glad to see that he wasn't jailed for the child porn case in California just because of the stir he caused around the JonBanet Ramsey case. It does show that our system works pretty good in at least that one respect -- meaning that it didn't prejuduce his case. For all those demanding justice, don't think for an instant that John Mark Karr is getting off scott free. At the very least, no school in America will hire this guy, so he wont be able to pretend to be a teacher anymore. At the very worst, people will recognize him wherever he goes, and I predict that he will be beaten and mugged and probably even sodomized or killed on the streets. (The same fate that would have awaited him in prison).
