Cheney to be Called as a Defense Witness in Libby Trial

The Plame ridiculousness is back again. It's just breaking on Fox News that Vice President Dick Cheney is to be called as a defense witness by Scooter Libby's team. Here's the AP report:

Vice President Dick Cheney will be called as a defense witness in the CIA leak case, an attorney for Cheney's former chief of staff told a federal judge Tuesday.


"We're calling the vice president," attorney Ted Wells said in court. Wells represents defendant I. Lewis "Scooter" Libby, who is charged with perjury and obstruction.

Early last week, Special Prosecutor Patrick Fitzgerald said he did not expect the White House to resist if Cheney or other administration officials are called to testify in Libby's trial, expected to begin in January.

Libby is accused of lying to investigators about what he told reporters regarding former CIA operative Valerie Plame. Plame's identity was leaked to reporters around the time that her husband, former ambassador Joseph Wilson, publicly criticized the Bush administration's prewar intelligence on Iraq.

Sitting presidents, including Clinton and Ford, have testified in criminal cases, but presidential historians and separation-of-powers experts said they knew of no vice president who has done so. The first President Bush was subpoenaed to testify in the Iran-Contra trial of Oliver North. At the time, Bush was Reagan's vice president, but Bush was president by the time a judge ruled he did not need to testify.

In addition to Cheney, other government officials and journalists are expected to be key witnesses in the trial, which is scheduled to start next month.

Former New York Times reporter Judith Miller and NBC News Washington bureau chief Tim Russert are expected to be prosecution witnesses. Libby's lawyers said in court papers that several reporters will testify on Libby's behalf.

Gee Willikers... back when the Plame's civil suit was filed the Legal Eagle Wiznuts swore and assured me that the Plame's civil suit would be thrown out of court post haste. Has that happened yet? no....

As I explained back then, the civil case judge can not rule on the merits of the civil suit until the criminal case had been concluded. No judge would protect the Plame's civil suit defendants without there first being a determination of guilt or innocence in the criminal case.

Depending on how the criminal case plays out, and what evidence comes to light, the civil case may be the real fireworks show on this issue.

Armitage already fessed up that he was the 'leaker' and Fitzgerald has given him a pass and said 'no harm no foul'. Yet Libby is still being persecuted because he supposedly 'lied' about a non-crime which the perpetrator has already 'confessed' to.

How is Cheney supposed to testify in a trial where Libby supposedly 'lied' to reporters, when Cheney wasn't a party to the conversations?

Since Libby is claiming that there was a difference in recollection, Russert can't claim that Cheney was involved in the conversation, since he never disclosed that in his testimony.

It's amazing the the media's first portrayal of the whole Plame Affair and Wilson's initial charges are all that a certain group remembers. Nevermind that consequently no one was charged with "outing" Plame. Nevermind that Armitage was found to be the original "leaker" way back in the beginning. Nevermind that Libby hasn't even gone to trial yet for purportedly lying about something he was never charged with. Nevermind that Plame & Wilson are suing Rove, Cheney and Libby, but not Armitage.

I don't even think Armitage did it deliberately. But don't anything stop some of you from smugly sneering over what is essentially a non-issue. If that's all it takes to make some of you happy, we are certainly in a sad state of affairs. What a bunch of children.

I don't even know exactly what it is that he was supposed to have lied about. The problem is posts like "nogo's" latest above. And I hope, Herman, that you're not so new to politics that you've forgotten, or are unaware of, the string of scandals throughout the 90's. The 90's were littered with one scandal after another. Whitewater, rape charges, memogate, travelgate, Chinese spies, etc. And that was just the White House.
