Obama's Justice Department is Investigating Sheriff Arpaio for Enforcing Immigration Laws

Sheriff Arpaio of Maricopa County, Arizona, also known as Sheriff Joe, is the most famous sheriff in the country for his no nonsense take on law enforcement. Those law breakers who are unfortunate enough to find themselves arrested and incarcerated in Sheriff Joe's tent city prison find that they are required to suffer the "humiliation" of *gasp* wearing prison stripes and pink underwear, eating only baloney sandwiches, and walking in chain gangs. Sheriff Joe's rules have long violated the left's delicate sensibilities, so the left considers him to be a monster that must be stopped. They may get their way, too, as Obama's Justice Department has started an investigation into Sheriff Joe. Not because of these previously mentioned "abuses" but because he has dared to enforce immigration laws:

The Department of Justice (DOJ) has launched an investigation of the Maricopa County Sheriff's Office in Arizona following requests by congressional Democrats and allegations by liberal activists that the department has violated the civil rights of illegal aliens.

Reps. John Conyers (D-Mich.), Jerrold Nadler (D-N.Y.), Zoe Lofgren (D-Calif.), and Robert Scott (D-Va.) requested the investigation, and activists groups such as National Day Laborer Organizer Network and ACORN launched petition drives and rallies in support of the probe.

The investigation focuses on Sheriff Joe Arpaio and dozens of officers under his command who were trained through the Department of Homeland Security's Immigration and Customs Enforcement's Agreements of Cooperation in Communities to Enhance Safety and Security (ACCESS), which partners federal and local law enforcement to enforce immigration laws. (The Homeland Security's Immigration and Customs Enforcement division is known popularly as ICE.)

This investigation is frivolous and nothing but an attempt to appease the pro-illegal immigration lobby that owns the Democratic party. It's also a terrible waste of taxpayers' dollars, especially at a time when we don't have the extra cash to throw around. Sheriff Joe is one of, if not the only, law enforcement officer who is not afraid to follow the law:

Concerning the DOJ's investigation, Arpaio told CNSNews.com: "I will not back down. What I am doing is upholding the laws of the state of Arizona, and I will not be persuaded to turn my back on my oath of office as sheriff of this county."

Sheriff Joe outlines on his website the process of determining an arrestee's residency status:

I uphold those laws wherever, whenever it is possible and lawful to do so. I have asked my deputies to train with the federal government so they may help in the fight against the illegal immigration. Today, I am proud to say I have the largest contingency of cross certified law enforcement men and women (160 of them) who are out patrolling in an intensified effort to bring illegal immigrants to justice.

I have also started an effort inside my jails. Many local police agencies do not want to be in the business of determining a lawbreaker's residency status. An illegal immigrant breaks the law - local police bring them to jail and charge them with the crimes they committed on the streets. My detention officers take thins [sic] a step further. They are now trained to follow up with each of those arrested and, if the arrestee is found to be in the country illegally, my officers charge him/her with that crime as well.

Sheriff Joe scoffed at the investigation and responded by inviting Congressman Conyers to Arizona to check out the jail:

"He (Conyers) can come here," the sheriff said. "I wrote him a letter inviting him to come to Phoenix. I'll take him to the tents. But, he never responded."

The "tents" are Arpaio's Tent City Jail. The federal investigations were triggered by the sheriff's decision last month to put 200 illegal immigrants, held for various violations, in a segregated part of Tent City. The sheriff's crime sweeps also have been criticized as racial profiling against Hispanics.

Arpaio said before he would go to Washington to testify before Conyers' committee, "He's going to have to come here and I'll show him the real story. I'll even buy his airline ticket."

The investigations by the Justice Department and Congress are nothing more than politics at play, Arpaio said.

"How come everybody's a Democrat? Everybody that's involved in this."

He said he has a message for Conyers: "Do you really think I'm going to surrender?"

Good for Sheriff Joe.

Hard to keep track of who supposedly owns the Democratic Party these days. Is it the pro-illegal alien lobby? What about the mandatory abortionists? Or is it George Soros' cabal of meanies? And, if it is illegal alien sympathizers running the party, why do they seem so beholden to organized labour (which is very much anti-illegal immigration)?

Actually, I think you might be on to something. It is indeed difficult on a day to day basis to know who "owns" the Democratic Party. I would be willing to bet that the ideological "coalition" that is now the Democratic Party is quite wide ranging and ownership does indeed change from day to day - depending upon who is crying the loudest or who is on the President's appointment schedule for the day. A lot of promises have been made to very diverse groups of interests to achieve Obama's election. It will be a real finesse act for him to juggle the conflicting aims of these groups.

Illegal immigrants are sources of votes for the Democrats. Wherever you see ACORN, you're guaranteed to see something corrupt.

The Sheriff is stopping the Democrats flow of voters and, of course, Obama needs to have this stopped!

Why do you think Democrats don't want voters to have IDs? If every voter had to have one, the ACORN people couldn't get illegals to go and vote.

What business is it of these people to stick their noses into a state or county that they don't even represent? Seems to me that these people are over-reaching just a tad. There is such a thing as the Tenth Amendment granting the states this right to do as they see fit. Ambrett Spencer had a miscarriage when delayed treatment in Sheriff Joe's custody.
Four other inmates or their family members contacted New Times this year, describing miscarriages, stillbirths, or harsh conditions for pregnant women in Arpaio's jails.

They blame poor medical care or, at times, no medical care. They also say that rotten food, potentially contaminated water, a lack of prenatal vitamins, and careless detention officers contribute to the problems.

Records show the claims may not be groundless. For example, the water well in the facility where pregnant women are jailed has been infested with mice and mice feces since 2005, Maricopa County Environmental Health Services Records show.

Mice carry a parasite -- toxoplasma -- that can infect water and cause birth defects, according to the Centers for Disease Control. It's so dangerous that the CDC says pregnant women shouldn't even touch litter boxes -- because cats eat mice and their feces can contain the parasite.

"Most infected infants do not have symptoms at birth but can develop serious symptoms later in life, such as blindness or mental disability," the CDC writes in its description. "Occasionally infected newborns have serious eye or brain damage at birth."

In addition to that parasite, Dr. Leslie Barton, a pediatrics professor at the University of Arizona School of Medicine, has found that mice feces and urine also carry a virus that can cause birth defects, including chromosomal defects.

I bet steve-o is beaming with pride.

Michelle McCollum was in the first trimester of her pregnancy she was attacked by two other inmates, Two inmates punched McCollum in the stomach repeatedly. After the attack, she and another inmate cried to guards for help. But McCollum writes that detention officers refused to bring her to the infirmary -- even after she told them she was pregnant and injured.

Three days after the attack, McCollum's bleeding wouldn't stop. She was finally taken to the Maricopa County Hospital. There, doctors said she had miscarried and ordered that she return to the hospital for a checkup.

Despite her reminders, jail personnel did not take McCollum back to the hospital. On September 17, she began bleeding again. The bleeding wouldn't stop.

An ambulance finally rushed McCollum back to the hospital -- where doctors gave her a blood transfusion because she had lost so much blood. Then they performed a procedure called a D&C, which removed the remains of the pregnancy.

For the morons out there,

the Bill of Rights applies to everyone, even illegal immigrants. So an immigrant, legal or illegal, prosecuted under the criminal code has the right to due process, a speedy and public trial, and other rights protected by the Fifth and Sixth Amendments. This fact sheet from the National Lawyers Guild outlines a host of rights afforded to immigrants and citizens alike.

(There are a few rights reserved for citizens. Among them are the right to vote, the right to hold most federal jobs, and the right to run for political office.)"

NAHJ is particularly troubled with the growing trend of the news media to use the word "illegals" as a noun, shorthand for "illegal aliens". Using the word in this way is grammatically incorrect and crosses the line by criminalizing the person, not the action they are purported to have committed. NAHJ calls on the media to never use "illegals" in headlines.

Shortening the term in this way also stereotypes undocumented people who are in the United States as having committed a crime. Under current U.S. immigration law, being an undocumented immigrant is not a crime, it is a civil violation. Furthermore, an estimated 40 percent of all undocumented people living in the U.S. are visa overstayers, meaning they did not illegally cross the U.S. border.

Arrest records from crime sweeps conducted by the Maricopa County Sheriff's Office add substantial weight to claims that deputies used racial profiling to pull Latino motorists over to search for illegal immigrants.

The records show that most people arrested were Latinos, even when the sweeps were held in predominantly White areas. The sweeps frequently targeted heavily Latino areas or day-labor corridors, and most of those arrested during highly discretionary stops for reasons such as cracked windshields were Latinos, the records show. Immigration enforcement also seemed to be a main goal of the operations, which is prohibited: In five of the eight sweeps, immigration arrests outnumbered other types of arrests, the records show.

Oh, sorry, about that. You're right, Joe hasn't had is day in court yet, on this I mean. I'm jumping to conclusions, kinda like if I saw a hispanic and automatically assume he jumped the border.

I mean sure, there are quite a few complaints by pregant inmates against sherrif Joe and sure, there have been numersous miscarriages in Joe's custody and sure the water well is infested with mice, which causes birth defects, all of that is factual. but still Sherrif Joe, has not had a chance to defend himself on this one.

Now, Sherrif Joe has had a chance to defend himself on numerous other complaints and has cost the city 43 million dollars for his actions, so it shouldn't be too hard for me to find another example should it?

Richard Post was a paraplegic inmate arrested in 1996 for possession of marijuana and criminal trespass. Post was placed in a restraint chair by guards and his neck was broken in the process. The event, caught on video, shows guards smiling and laughing while Post is being injured. Because of his injuries, Post has lost much of the use of his arms. Post settled his claims against the Sheriff's office for $800,000

or one of my favorites.

1996, Jeremy Flanders was attacked by inmates at Tent City who used rebar tent stakes, which were not concreted into the ground. Although these stakes had been used as weapons in a previous riot at the facility, the Sheriff's office chose not to secure them properly. During the trial, the plaintiff "presented evidence that, among other things, the Sheriff and his deputies had actual knowledge that prisoners used rebar tent stakes and tent poles as weapons and did nothing to prevent it." Furthermore, "the Sheriff admitted knowing about, and in fact intentionally designing, some conditions at Tent City that created a substantial risk of inmate violence." After the attack: "another inmate entered the tent and found Flanders unconscious, gasping for air, and spewing blood out of his mouth, nose and ears. Flanders had been bloodied and beaten so badly that the other inmate initially did not recognize Flanders." Flanders suffered permanent brain damage as a result of the attack. On appeal, Flanders was awarded $635,532, of which Arpaio was personally responsible for thirty-five percent.

Later, a city "conflict resolution manager" walked up and laid down an Arizona law book. City Attorney Verburg told the deputies again that Stern had the right to look at any public record. Actually all to to the topic of civil rights, which was for everyone's benefit. Although you may be a narcissist, keep in mind that I'm not always writing to you. In fact I don't address you at all in most of the posts. I was showing everyone what a gigantic bucket of sadist scum Sherriff Joe is. You don't deny the scumminess I listed, so I assume you don't deny any of it. So it is established you don't disagree Sherriff Joe is a scumbag who lets his deputies beat up on the paralyzed. Now I will address your actual question.

And BTW, he did the sheriff curtail free speech? You never answered that question. Sherriff Joe has arrested reporters for writing articles about him not giving medical care to pregnant women punched in the belly. So stay with me, Arresting reporters for writing things you don't like is an attack on free speech. An attempt to suppress it if you will. The Phoenix New Times files suit last year, for this and for harassing reporters, who are looking up public documents related to Joe. Also his deputies have arrested people for clapping too loud in town hall meetings calling for Joe's ouster.

So now it is my turn, I want some answers to questions although I have a hunch you will duck them. How can a pro-lifer, who claims to support the rights of the unborn, not condemn pregnant women getting their water from a mice infested well, which causes birth defects? How can a pro-lifer who claims to support the rights of the unborn not think it is a bad thing that a woman with child, was punched in the belly and then denied medical treatment by the guards?

I have a hunch, you won't answer these questions. bet I know why.

What the fuck is wrong with you? First of all, a lot of the people being mistreated by fascist Joe are pre-trial detainees, meaning they haven't even been convicted of a crime.

You have to understand you are in Right Wing Land. In Right Wing Land people don't believe in innocent 'till proven guilty. As soon as you are accused of a crime you are guilty and therefore should wear pink underwear and be abused by sadisitc Joe.

In right wing land, the state gets to round you up and you don't have to demand they provide evidence, that you deserve to be locked up (See Guantanamo) If you are brown you are guilty.

Now there are exceptions to the "you are guilty before you go trial" rule, in Right Wing land.

For example, take the case of convicted felon Scooter Libby. Scooter Libby, is innocent even though he is a convicted felon. So as a convicted felon, noone should ever make Scooter Libby wear pink underwear. If you are not a convicted felon though, if you haven't even had your day in court, hadn't had a trial, but are detained 'till your trial... it is okay for sadistic Joe, to humilate and beat you, (the kind of thing they've had to pay out 43 million dollars for) If you are a convicted felon, on the other hand, that people in right wing land like. then it's bad and should be pardoned as soon as possible.

Don't look for consistency in right wing land most of these poeple have no values. Sure some of them will tell you things like they are pro-life and support the rights of unborn children, but it is BS. In right wing land they will tell a sherrif that denied medical care to pregant lady punched in the belly "Go JOE!"

jmc - "I have a hunch, you won't answer these questions. bet I know why."

What questions would those be jmc.

Those related to being a so called "pro-lifer?"

If so, you're barking up the wrong tree.

Other than evil incarnates like george "killer" tiller and those that avail themselves of his "services" down in Kansas I could care less what a woman does with her body.

I have a hunch that jmc had the opportunity to wear some pink underwear. There is such a huge back story of hatred for this guy.

jmc, I have to tell you this, but jails and prisons are full of "innocent" people. At least that is what all the convicts say. I stand by what I said, I will take the word of the person that puts his or her life on the line then from a criminal that would do anything to con someone to get away with something. You my friend are an easy mark. ww

I do hate people who think it is okay to deny medical treatment to a preganat lady punched in the belly. So yes Willie. I hate you.

First off Willie, not everyone there has been convicted of a crime. You are not bright, but even you know that in America people are innocent until proven guilty. Some of the people Joe, locks up and humiliates haven't had there in court yet. They are pre-trial detainees. That means, they are still innocent until proven guilty. If you don't like that get your ass to Cuba or someplace where they don't share american values of justice.

Secondly, I never claimed everyone in his jail is innocent you nitwit. I'm not for releasing them, I'm for treating them as they are treated in jails across the country. that means no laughing at a papelegic while his neck is broken. I'm not a sadistic scumbag like you. Maybe the idea of of putting people in pink underwear gets your jollies off, Maybe that is a turn on for you, but it's not for me.

jmc, first of all, I do not... (Below threshold)
WildWillie:

jmc, first of all, I do not "hate". It does not accomplish anything except maybe hurting myself. Secondly, innocent until proven guilty is a court room bar, not societal. If I see my neighbor robbing a bank and shooting a teller and leaving in a car that he parks in his driveway everyday, I do not have to think of him as innocent. I suggest you get your emotions in check and realize, even though there are a very minor few innocent people in jails, almost all know they are there for the right reason. They continue to prey on people like you whose heart is in the right place, but your mind shuts off. The ONLY thing between me and the criminals roaming the streets are deputies like these. I prefer to thank them and give them the benefit of the doubt. Their job is hard enough without me adding stress to them with false allegations and distractions. ww

true enough and commendable.

The lady who lost her child was there for a DUI, which she got before she found out she was pregnant. After that, she quit drinking and entered rehab. She made a mistake, however, and she was serving her time for it.

When she was punched in the stomach, violently assaulted by other inmates, the sheriff and his deputies should have got her medical care right away. They didn't. they waited three weeks and she lost the baby. This despite her pleading for help, telling them she was in pain. This lady was not a murderer. If this were an isolated incidnet, I wouldn't be so upset. it's a pattern in the sheriff's care.

Willie, if these allegations I'm making are false, why has the sherrif had to pay 43 million dollars in lawsuits? There are bad people in the sheriffs jails, really bad in some cases. That is not excuse to break a man's neck, or to not clean up a well, infected with mice, when you have pregnant women in your care.

Also as I said, some of these people are pre-trial detainees. That means it could be some guy accused of getting in a fight or something. he goes to court and wins because it turns out he did nothing but defend himself. He is innocent. The only problem is, while he waiting for his court date to prove his innocennce the sheriff has been marching him around in pink underwear, forcing him to sleep in a tent, and basically doing things that are not done in any other jail in america. I'm sorry, I think it is our duty to make things as hard as possible on this guy.
