Polanski Arrested, What Next?

Director Roman Polanski was arrested by Swiss authorities in in Zürich today on an arrest warrant for his 1978 statutory rape of a 13-year-old girl in Los Angeles. The media is now speculating that this is good news for Polanski, as he may escape serious punishment and win his freedom.

That really would be a horrible outcome. Why? Just check out the summary of the grand jury transcript from The Smoking Gun:

Two weeks after Polanski plied her with Champagne and a Quaalude, Samantha Gailey appeared before an L.A. grand jury and recalled Polanski's predatory behavior in a Mulholland Canyon home owned by Jack Nicholson.

The teenager's troubling--and contemporaneous--account of her abuse at Polanski's hands begins with her posing twice for topless photos that the director said were for French Vogue. The girl then told prosecutors how Polanski directed her to, "Take off your underwear" and enter the Jacuzzi, where he photographed her naked. Soon, the director, who was then 43, joined her in the hot tub. He also wasn't wearing any clothes and, according to Gailey's testimony, wrapped his hands around the child's waist.

The girl testified that she left the Jacuzzi and entered a bedroom in Nicholson's home, where Polanski sat down beside her and kissed the teen, despite her demands that he "keep away." According to Gailey, Polanski then performed a sex act on her and later "started to have intercourse with me." At one point, according to Gailey's testimony, Polanski asked the 13-year-old if she was "on the pill," and "When did you last have your period?" Polanski then asked her, Gailey recalled, "Would you want me to go in through your back?" before he "put his penis in my butt." Asked why she did not more forcefully resist Polanski, the teenager told Deputy D.A. Roger Gunson, "Because I was afraid of him."

Following his indictment on various sex charges, Polanski agreed to a plea deal that spared him prison time (he had spent about 45 days in jail during a court-ordered psychiatric evaluation). But when it seemed that a Superior Court judge might not honor the deal--and sentence Polanski to prison--the director fled the country.

Really do you feel sorry for Polanski, being holed up in his native France for all these years? What has he done to earn the right to not serve time for his crime?

I'll just note it wasn't just statutory rape, it was rape, period. He gave alcohol and drugs to the girl and had sex with her without her consent.

He's a sexual predator as well as a child molestor, and should be treated as such.

I want him locked up. I am grown up enough to follow this case and address the serious issues of today. Unfortunately, he is an acclaimed director, a Hollywood idol and leftist in his beliefs so he will get a pass. NO matter how the girl/woman feels. ww

It will all go away shortly. All that needs to be done is to sentence him. The guilty verdict has already been entered. He'll get sentenced and go to prison. Who knows how much time he'll get. Not as much as he deserves is the best bet. He seems to think hat he should get a do-over as reward for evading justice for 30 years. I hope that the courts aren't that stupid.

Europeans and many socially liberal people not only "laid back" about this whole thing, I've seen editorials where they attempt to excuse his actions by saying the child was already sexually active.

There is no excuse for plying a 13 year old with alcohol and narcotics and then raping her, whether or not she is already sexually active. Polanski is a confessed child rapist. I'm not sure why there is even an argument or delay. If we were talking about Polanski the unknown middle class contruction worker, he would be back in the states and in prison already.

I believe that most teenagers can make informed decisions involving sex in this day and age what with governments wanting to start SexEd in kindergarten now. In most cases of Statutory Rape I think the law is stupid (i.e. 18 year old and 16 year old or similar) but when the youngster is 13 and the offender is 30 years older I see why this law exists. Unfortunately courts are not allowed discretion in the former because of the latter.

I have a 5 and 4 years old daughters and though I would hate it I would not prosecute a boyfriend only a few years older simply because of age difference. He might meet my shotgun full of rock salt though.

This is not about Statutory Rape, this is real rape and the man is a predator. Lock him up and throw away the key. Actual Rapists and Pedophiles should be castrated before they are released.

Actually ww the comment was more about news cycles being wasted relating to covering this than the case. Just what I really want to be hearing about on say Greta for another year, reminds me of all the wasted time on the Peterson or Holloway cases that dragged on forever, time better spent on say that pesky health care debate, or the ongoing foreign policy disasters unfolding. I find those far more important, effecting far more people, than covering some jackass from 1978 who actually wants the attention. But if you would rather interpret the comment as pro-rapist, well then enjoy.

What you are really asking is if I believe teenagers should be allowed to vote? My answer is that older and stupider people get to vote so maybe they should?

Honestly I understand the need to place some sort of age on the statutes for driving, drinking, consent, voting and so on however why can an 18 year old die for his or her country but can't buy alcohol?

I almost believe that you should be required to serve your country before you get the right to vote in national elections. States can make their own decisions.

Also, let's feather this "alleged rape" business. He pled guilty, which means he agreed that he raped the girl.

And on another correction, the victim's viewpoints on Polanski are irrelevant. She was the victim of a crime, but the crime was against society, not her personally, because Polanski broke the law. No prosecutor needs the victim's approval to prosecute criminal behavior (although as a practical matter it may be difficult without the victim's cooperation, but that's a different question).

Your choice of words and the way you play with them to express your outrage/disgust/whatever on a regular basis is duly noted. Again.

Actually, WildWillie, he seems to put some weight on when it happened. Perhaps he would have a different opinion if it happened in 1998 - or maybe 2008. Who knows? Only SillyPuddy knows.

Just because a crime is thirty years old does lessen the severity of it. Rape is rape and I find it disgusting that people want him to be free. He has been free of punishment for decades. I think the victim of this crime has said she does not want him punished and has forgiven him because she has dealt with scrutiny and mental turmoil for the last thirty years. She may be at a point in her life when she doesn't want to relive that incident all over again. I think Polanski deserves to be locked up and serve his time no matter how many accolades he has received.
