Well, that explains a lot ...

The Obama Justice Department has overturned an election in the small town of Kinston, NC. The townspeople voted overwhelmingly to remove party affiliation from the ballots in local elections. The Justice Department nullified their wishes:

Voters in this small city decided overwhelmingly last year to do away with the party affiliation of candidates in local elections, but the Obama administration recently overruled the electorate and decided that equal rights for black voters cannot be achieved without the Democratic Party.

The Justice Department's ruling, which affects races for City Council and mayor, went so far as to say partisan elections are needed so that black voters can elect their "candidates of choice" - identified by the department as those who are Democrats and almost exclusively black.

The department ruled that white voters in Kinston will vote for blacks only if they are Democrats and that therefore the city cannot get rid of party affiliations for local elections because that would violate black voters' right to elect the candidates they want.

Several federal and local politicians would like the city to challenge the decision in court. They say voter apathy is the largest barrier to black voters' election of candidates they prefer and that the Justice Department has gone too far in trying to influence election results here.

Stephen LaRoque, a former Republican state lawmaker who led the drive to end partisan local elections, called the Justice Department's decision "racial as well as partisan."

"On top of that, you have an unelected bureaucrat in Washington, D.C., overturning a valid election," he said. "That is un-American."

The decision, made by the same Justice official who ordered the dismissal of a voting rights case against members of the New Black Panther Party in Philadelphia, has irritated other locals as well. They bristle at federal interference in this city of nearly 23,000 people, two-thirds of whom are black. (emphasis added)

Wow. Blacks and the poor must be compelled to vote for Democrats; workers must be compelled to unionize, and so forth. Because, you know, if people reject left-leaning choices then they have been duped, tricked, defrauded, or scammed. There are no legitimate alternatives to liberalism, there is only racism, bigotry, hate, and greed. I think that's what the Justice Department is saying here.

Since liberals have gained full control of the Federal government, the "fairness" facade that they have so carefully erected and maintained for the last forty years is starting to crack. Now we know it's not about "justice" and "civil rights" -- it's about rigging public offices and private advocacy groups to become permanent Democrat strongholds. They can't deny it any longer.

Maybe AG Holder was right after all. It seems to me that liberals are very afraid of having an honest discussion about race in this country, because to do so would probably cost them a great deal of their power.

There is another good analysis of this decision by Clarice Feldman at Pajamas Media. Ms. Feldman concentrates on the influence that the Voting Rights Act played in the Justice Department's ruling. She also notes a comment by Abigail Thernstrom, the vice-chair of the U.S. Civil Rights Commission:

The Voting Rights Act is supposed to protect against situations when black voters are locked out because of racism. There is no entitlement to elect a candidate they prefer on the assumption that all black voters prefer Democratic candidates.

Well, if I couldn't tell which candidates were black, I wouldn't know who do vote against. I don't blame the Department of Racial Justice. Seems perfectly legitimate. Just doing their job. Everybody knows that a white person won't ever vote for a black candidate.

Maybe there's a compromise. Maybe they would agree to drop the party designations if the ballot identified all black candidates with a notation such as "(Oppressed Minority - vote for this one)". Or "(Look for the Union Label)".

Hmmm, exactly where in the Constitution of the United States is the Federal Government given the authority to validate or invalidate a local election? That city, the county it is in and the state need to tell the justice department to go pound sand, and hold elections the way their citizens want. Other than threaten to withold money, there is little or nothing the federal government can ultimately do about this.

The Department of Justice just called every black person in that town an idiot who doesn't know anything about who they are voting for! They basically just called them all too stupid to vote the "right way" without help from a little "D" next to a name.

The only reason the ever-so-sensitive lefties don't cry racism is because it helps keep the people they want in power right where they are. The left and the democrats are the ones holding back progress. The same Democrat party that formed SPECIFICALLY to stop desegration and keep black persons "in their place" in the south; and to keep any republican, especially a black man, from ever holding office in the south.

That is the same party of today, except they have convinced themselves that the same policies they wanted to use to hold minorities down, are now the same policies that will lift them up!

The party affiliation next to the name doesn't "compel" anyone to vote for the candidate; it simply provides a cue to the voter as to which candidate will likely support the black community.

So now they are calling white democrats Racist! because they won't vote for black candidates unless they are "the right kind" of black candidate? And you are wrong (jpe) if its calling the whites idiots then its is calling both Whites AND blacks idiots.

And at the end of that statement it basically says that blacks are not in the majority, and therefore we have to give them help to get their candidates elected. WHAT THE HELL? Why should any candidate get help because his constituency is smaller than his opponents? That is not the way it works!

This whole decision is asinine! Clearly designed to try and keep Democrats in power through legislation instead of elections.

Its time to get rid of the Voting Rights Act AND Affirmative Action in my opinion. The discrimination that these were intended to ereadicate, have been eradicated almost entirely. All they do now is serve as a crutch on the way to dependence on the government rather than self reliance in minority communities.

And on a related note concerning the VRA if you want to vote you have to be a legal citizen. To be a naturalized citizen you have to speak english. SO WHY THE HELL DO THEY REQUIRE BILINGUAL BALLOTS?

That's simply how the law is structured. Again, don't blame the DOJ for enforcing the law as written. So, contra your comment, that's exactly how it works and how it was designed to work.
Its time to get rid of the Voting Rights Act
Personally, I think the "effects test" component of the VRA is troubling; I wouldn't mind if it got the heave-ho.

I think I owe you an apology for overreacting to your well reasoned argument. I thought you were arguing in favor of the action, when in fact you are simply saying "ho-hum" because unfortunately that is the way the law is written.

Of course I just read through part of the VRA and I don't think it was intended to be used as such, but unfortunately the left is good at misinterpretting anything that is the tinest bit left open to interpretation.

That is why the health care bill in its current forms needs to die and be rewritten IRON CLAD. Or better yet, keep government out of it until they can fix medicare/aid to show us they know what they are doing.

re: effects: the VRA precludes the southern states from changing procedures if "will have the effect of diminishing the ability of any citizens...on account of race...to elect their preferred candidates." It's still a jump from that to the kind of positive and purported "right" to representation (as you correctly note), so I was a bit hasty in assuming the DOJ correctly interprets the law that way. I'm digging into the law now to see if that's right (although I think they're right on the law, even if I agree that the effects test is dicey at best)
