When The Phone Don't Ring, You Know It's The White House

Arizona's governor, Jan Brewer, ought to have her phones checked.

Last night, she said that she had no idea that Arizona's illegal immigration law was featured in the Obama administration's report on "human rights concerns" within the US to the UN's Human Rights Council.

This is reminiscent of how the Obama administration handled its legal challenges to the law: they never bothered to talk to Arizona officials at that time, either, instead just doing their communicating through press releases and court filings.

It's not legally required for them to notify Arizona when it does things like this, but it is considered courteous and professional to give them a heads-up when they do.

Perhaps Arizona should look into doing some things that does get the Obama administration's attention and willingness to engage in discussions. They're neighbors with New Mexico and Nevada, and I believe both states have nuclear weapons test ranges they're not using. If Arizona were to say it was looking at building nuclear weapons, and opened talks with leasing out White Sands and the Nevada National Security Site, then perhaps they'd be treated with a bit more respect -- the kind the Obama administration currently reserves for states like Iran and North Korea.

Hey, it's not like the Obama administration could end up disliking Arizona any more than they already do...

Did Obama check in with the rest of the country before he decided that the Federal government would stop enforcing Federal laws - and prevent states from doing so (since they've been doing that for a couple of hundred years now)?

If a police officer caught someone with a bale of obvious counterfeit money, would they let the owner go?

If someone was dumping toxic waste in a reservoir, would they stop it, or just call the EPA?

On the other hand, when a local government decides to allow locals to break Federal law (medical marijuana, for example), some folks think that's just fine. It's a case of "local laws overriding Federal laws" (which is really, REALLY not allowed).

Brewer didn't attempt enforce Federal law. Since the Federal Government was not enforcing its laws and that failure of enforcement was causing problem in the state of AZ, the AZ legislature passed a state law that was essentially identical to the Federal law.

Once you remove your head from your anus, you might consider the fact that I was talking about obama's perception to the world at large, none of whom give a rat's ass how SCOTUS eventually rules. Also I said nothing about SCOTUS in my comment because it was irrelevant to the point I was making which was not about how the case will be decided but how he has sacrificed his office's prestige by acting in the manner that he has chosen.

And while you may be auditioning for the role of Nostradamus, the SCOTUS ruling is by no means a foregone conclusion and there have been a number of serious legal scholars that think Barry's going to lose this one. His argument on preemption is extremely weak and even he knows it.

Also Dane even if SCOTUS rules against the law it cannot do so based on discrimination as the law was never allowed to go into effect and be used in a way that would prove discrimination.

The Administration has offered the argument that Federal law preempts the state law and therefore only the Federal government can enforce that law. This is nonsense as there are many laws that are passed at the state level that mirror federal laws for the simple reason that the federal government lacks the resources to police the entire country.

Additionally, the AZ law only provides for the detention of people who are in the country illegally. Anyone detained has to be turned over to Immigration for them to handle, so the law in no way interferrs with the federal governments right to prosecute anyone.

The case is poorly briefed and is quite possibly a loser for the president. He has not learned how to fight his battles. He also will have problems as there are a number of states (Rhodes Island for one as I mentioned before) that already have similar laws. obama is very good at demagogueing the issue while ignoring that the law has been in effect elsewhere and has not been a problem.

As to the rest of the slobbering commenters, a SCOTUS decision that goes in favor of Obama will show the AZ lawmakers were motivated by their racism to push through a law that was eventually so faulty it wasstruck down by SCOTUS.

It will show that, as usual, the conservative asshats let their racist, bigoted ways drive them to try to usurp federal power so they could harass the brown skins in their fair-haired state into leaving.

My original point was that obama did not need to get involved in this and that his AG should have been the focus. He has been drawn into a battle on a subject where he has made himself the equal of someone ranked below him and if he loses he will be seriously diminished. If he wins he will have shown that he can be seriously sidetracked by provincial officials whose powers are far more limited than his.

He has shown that he cannot manage his government and that he cannot trust his admin to handle what should be minor internal squabbles. He has to wade into the fray in order to get what he wants. If he loses he will be seen as weak and ineffectual.

He cannot win in the eyes of world leaders. They will see him as weak either way.

The motives of the Arizonians were racist. I never said the law was racist, only that their motives were. And if the SCOTUS rules on the side of the Obama administration it will be clear that the Arizona law was motivated by race - that's the conclusion most Americans will draw.

If the law they proposed wasn't legal - why were the nice folks in Arizona so hell-bent on harassing brown skinned Americans in Arizona? Because they knew that harassing every Mexican - illegal or not - would drive Hispanics from the state - even the legal immigrants.

I think I made a serious argument that he created a no win situation where he's diminished if he wins because he has engaged in a local dispute once again that is beneath the station of his office, showing that he cannot trust his cabinet and cannot govern the country. Re the decision next summer - I knew the matter would be resolved by then, I was just wrong about the "why":

An earlier law passed by the Arizona legislature requiring every employer in the state to enroll in the "voluntary" E-Verify program operated by DHS had been upheld by the lower courts against similar arguments. The Supreme Court agreed earlier this month to consider the earlier statute and it is likely that when a decision is issued in that case next summer, we will have a better sense of the ultimate decision on this law as well.

Oh and Jay, thanks for the compliment. But connecting the dots (boy, you need a lot of help) - it was you who raised the Brewer vs. Obama faceoff. My point remains (pay attention this time, ok?) that Obama will prevail in that because Brewer's racist intentions will be revealed by the decision on the law.
